TJX Defendant Receives Jail Time and Fines

One of the defendants accused in the TJX credit card scandal has been sentenced to jail time. The Miami resident received a jail sentence of five years as well as fines of more than $600,000 fine for restitution because of his attempt to sell the credit card data acquired in the unlawful security breach.

The guy, Irving Escobar, was charged with having used counterfeit credit cards that he and several others created with the stolen data received from the breach. With the data they stole, Escobar and others recoded counterfeit cards and used them to purchase gift cards illegally.

Escobar pleaded guilty to his role in the scandal. His co-defendants have pleaded guilty to the same charges of conspiracy to commit fraud as well as for grand theft. The co-defendants have all been on probation since August.

Escobar’s mother pleaded guilty to her role in the scandal, and as a result, was deported back to Venezuela.

It looks as if justice is being served. According to the most recent reports, the information stolen was used to purchase $8 million worth of gift cards. In all, TJX is reporting $168 million in losses as a result of the breach. Many industry insiders, however, feel the figure is likely to be closer to $1 billion. Much of this is based on the belief that TJX customers are likely to make fewer credit card purchases at their stores as a result of the scandal.
